FAQ Series: CDC Announcement: What are the implications for Philadelphia landlords/property managers from the recent (August 4, 2021) CDC announcement for the eviction moratorium?

Question: What are the implications for landlords from the recent (August 4, 2021) CDC announcement for the eviction moratorium?

Answer:  

Although the media has made it unclear, here is the status:

  • Since July 2021 the City of Philadelphia landlord-tenant office began doing lockouts at a rate of 20 per day

  • There are an estimated 1,500 lockouts (writs filed) that are on the landlord-tenant officer’s backlog

  • The CDC issued an order on 8/4/21 that allows a tenant to postpone an eviction if the tenant qualifies for eviction protection based upon ONE the following parameters:

    • Received a stimulus check in 2020 & 2021

    • Not required to report any income to the IRS

    • Earned less than $99,000 or $198,000 as an individual or joint filer, respectively

  • AND additionally, has ONE the following parameters:

    • Household income has gone down substantially

    • Have been laid off from work

    • Work hours or wages have been cut

    • Have extraordinary out-of-pocket medical expense
