Lead Law Update (FAQ Series): If my tenant is not willing to give access to the property, is there an exemption that can be provided so that I can get my rental license renewed?

We are regularly receiving questions regarding the new Lead Law and have created a weekly “Frequently Asked Questions” (FAQ’s) forum for you as you desire to become more informed of the Lead Law and its complexity.

 

This week we are featuring a common question: 

 

QuestionIf my tenant is not willing to give access to the property, is there an exemption that can be provided so that I can get my rental license renewed?

 

Answer: Yes, The public health department requires the landlord to send them the following information:

 

1.   A copy of the mail receipt (certified mail) as proof that a letter was sent to the tenant requesting access to perform the lead test.

2.   The tenant(s ) name and phone number

 

 This information can be then sent to the Public Health Department for an “exemption” and if approved, this will be sent to Eclipse to allow you to renew your rental license.

 

Additionally, we offer a service to submit your eviction appear in eviction court on your behalf in case your attorney requires it including:


1. Posting a 24 hour notice on the tenants' door

2. Submitting to your attorney, a letter proving the tenant did not cooperate with providing access to perform the lead test


These documents will likely enable you to obtain an eviction hearing
