Lead Law Update (FAQ Series): For multi-unit (duplex, triplex, quadruplex, etc.) properties, does each rental unit require a separate lead certificate?

We are regularly receiving questions regarding the new Lead Law and have created a weekly “Frequently Asked Questions” (FAQ’s) forum for you as you desire to become more informed of the Lead Law and its complexity.

 This week we are featuring a common question:

 Question: For multi-unit (duplex, triplex, quadruplex, etc.) properties, does each rental unit require a separate lead certificate?

Answer: 

Yes. Each rental unit requires a separate lead certificate.  A duplex would require 2 certificates, a triplex requires 3 certificates, etc. The reason this is required is that the Public Health Department considers each lease as a separate unit.  Licenses & Inspections issues 1 (one) rental license for each property. This treatment is slightly confusing but in order to be in compliance, this is the requirement.
